Terms of Service

1.      General Terms

a.      By submitting a commission request and/or paying a deposit, you acknowledge that you have read and agree to these terms.

b.     I reserve the right to accept or decline any commission request at my sole discretion.

c.      Please submit all commission requests via the online form.

d.     If you provide photos or other artwork as references, you are responsible for ensuring you have permission to use them as references for your commission.

e.      Turnaround time varies depending on current order volume and the complexity of the project. I will provide an estimated timeline before work begins. Delays in receiving feedback, approvals, reference photos—especially for pet portraits—or other information from the client may extend the timeline.

f.        If you would like your commission to remain private, please let me know when you submit your commission request. I will respect reasonable privacy requests.

2.      Payment

a.      A 50% non-refundable deposit is required to begin work.

b.     The remaining 50% is due when the artwork is completed and before pickup, delivery, or shipping.

c.      The finished artwork will not be released until the balance has been paid in full.

d.     All prices and payments are in USD.

e.      Additional charges may apply for major revisions, additional design work, local delivery, shipping, or other requests that were not included in the original commission quote. I will discuss any additional charges with you before moving forward.

3.      Commission Process

a.      I will provide an initial draft or general plan for you to review before I begin the physical painting.

b.     Once the concept is approved, I will begin the painting. I will also provide progress photos or updates during the process.

c.      Minor changes can usually be made during the early stages of the painting.

d.     Once the painting is further along, changes become much more limited. Major changes to the composition, subject, colors, or concept at this stage may not be possible.

e.      If a major change is requested after the original concept has been approved, I may decline the change or charge an additional design/labor fee.

f.        If you decide to change the original concept after work has begun, the new request may be treated as a new commission.

4.      Cancellations

a.      You reserve the right to cancel your commission at any time, but the 50% deposit will not be refunded.

b.     If I am unable to complete your commission due to an issue or emergency on my end, I will notify you immediately. We will either arrange an extended timeline to accommodate the delay or issue a refund.

c.      If I am unable to reach you for 30 consecutive days, I will consider your commission abandoned. I will make at least (3) contact attempts via your preferred communication method before doing so.

5.      Pickup, Delivery, and Shipping

a.      In-Person Pickup: In-person pickup within the Indianapolis area is my preferred method of fulfillment. Pickup details will be arranged once your painting is finished and the final balance has been paid.

b.      Local Delivery: Local hand-delivery may be available for an additional fee, depending on the location and my availability. Delivery must be arranged with me ahead of time.

c.      Shipping: If you are outside the local area, may be available on a case-by-case basis. The client is responsible for shipping, packaging, handling, and insurance costs. Shipping must be discussed and approved before the commission begins.

d. Once the artwork has been dropped off to the shipping carrier, I am not responsible for any loss or damage that occurs during transit.

e.     I will hold completed artwork for 30 days after completion. If the artwork has not been picked up, delivered, or shipped within the 30 days and no other arrangements have been made, the commission may be considered abandoned, and the deposit will be forfeited.

6.      Artwork Ownership and Usage

a.      I retain the copyright and intellectual property rights to the artwork and original concepts I create.

b.     Purchasing the physical painting does not mean that copyright is transferred to the client.

c.      I may photograph and share completed commissions on my social media, website, portfolio, promo materials, or in prints. I may also post progress photos of the commission on my social media.

d.     Commissioned artwork is for personal use only. The artwork may not be resold, reproduced for commercial purposes, used on merchandise, used for advertising, or licensed without my written permission.  

e.      The artwork may not be used to train AI models without my written permission.

f.        You may not claim that you created the artwork.

g.      You may post and share the artwork online, but please credit me as the artist.

h.      Please do not substantially alter, digitally edit, or have another artist modify the original artwork.

7.      Final Agreement

a.      By submitting a commission request and/or paying a deposit, you acknowledge that you have read and agree to these terms.
